NOTICE OF PUBLIC HEARING

AN ORDINANCE OF THE TOWNSHIP OF WINSLOW, COUNTY OF CAMDEN, STATE OF NEW JERSEY REPEALING AND REPLACE CHAPTER 295A OF THE ZONING ORDINANCE OF THE TOWNSHIP OF WINSLOW TO ADDRESS THE REQUIREMENTS OF THE FAIR HOUSING ACT (FHA) AND THE UNIFORM HOUSING AFFORDABILITY CONTROLS (UHAC) REGARDING COMPLIANCE WITH THE WINSLOW’S AFFORDABLE HOUSING OBLIGATIONS

Ordinance Purpose: (Brief Summary)

This Ordinance, if and when adopted, shall provide for the following;

                       WHEREAS, the Township of Winslow Planning Board adopted a Fourth Round Housing Element and Fair Share Plan on June 17, 2025 pursuant to the Municipal Land Use Law at N.J.S.A. 40:55D-1, et seq.  The Amended Housing Element and Fair Share Plan was endorsed by the Mayor and Township Committee on June 24, 2025.  This Ordinance implements and incorporates the adopted and endorsed Fourth Round Housing Element and Fair Share Plan and addresses the requirements of N.J.A.C. 5:93-1, et seq., as amended and supplemented, N.J.A.C. 5:99, et seq., as amended and supplemented, N.J.A.C.5:80-26.1, et seq. as amended and supplemented, and the New Jersey Fair Housing Act of 1985. 

            NOW THEREFORE, BE IT ORDAINED by the Mayor and Township Committee of the Township of Winslow, Camden County, New Jersey, that Chapter 295A of the Code of the  Township of Winslow is hereby replaced to include provisions addressing Winslow’s constitutional obligation to provide for its fair share of low- and moderate-income housing, as directed by the Superior Court and consistent with N.J.A.C. 5:93-1, et seq., as amended and supplemented, N.J.A.C. 5:99, et seq., as amended and supplemented, N.J.A.C. 5:80-26.1, et seq., as amended and supplemented, and the New Jersey Fair Housing Act of 1985.  This Ordinance is intended to provide assurances that low- and moderate-income units ("affordable units") are created with controls on affordability over time and that low- and moderate-income households shall occupy those units.  This Ordinance shall apply except where inconsistent with applicable law.

                        BE IT FURTHER ORDAINED that Chapter 295A of the Township of Winslow Code, entitled “Affordable Housing” is hereby repealed and replaced as follows:

CHAPTER 295A AFFORDABLE HOUSING

Article I – Fourth Round Housing Element and Fair Share Plan consistent with the Consent Order Fourth Round In the Matter of the Application of the Township of Winslow, County of Camden, Compliance Certification ( N.J.S.A. 52:27D-304.q), with Township’s Fourth Round Affordable Housing Obligations in accordance with in Re: N.J.A.C. 5:99, P.L. 2024.c.2

 §295A-1  Introduction & Applicability.

§295A-2    Definitions.

§295A-3          Monitoring and Reporting Requirements.

§295A-4          New Construction Programs (per N.J.A.C. 5:93 as may be updated per various sections in N.J.A.C. 5:97 and N.J.S.A. 52:27D-301 et seq.).

§295A-5  Affordable Housing Programs.

§295 A-6 Regional Income Limits.

§295 A-7 Maximum Initial Rents And Sales Prices.

§ 295A-8    Affirmative Marketing.

§295A-9          Selection of Occupants of Affordable Housing Units.

§295A-11        Control Periods for Restricted Ownership Units and Enforcement Mechanisms.

§295A-12        Price Restrictions for Restricted Ownership Units and Resale Prices.

SECTION 2:     Except as set forth in Section 1, the balance of the Code of the Township of Winslow shall not be affected by this Ordinance.

SECTION 3:   All Ordinances or parts of Ordinances inconsistent with this Ordinance are hereby repealed to the extent of such inconsistency.

SECTION 4      If the provisions of any section, subsection, paragraph, subdivision, or clause of this Ordinance shall be judged invalid by a court of competent jurisdiction, such order of judgment shall not affect or invalidate the remainder of any section, subsection, paragraph, subdivision, or clause of this Ordinance.      

 SECTION 5:    This Ordinance shall take effect immediately upon final passage and publication in accordance with law.

Notice is hereby given that the foregoing Ordinance was introduced and passed upon first reading at a regular meeting of the Mayor and Township Committee of the Township of Winslow on the   24th day of  February, 2026 , at 7:00 P.M., and the same was then ordered published according to law; and the same ordinance will be further considered for final passage during a meeting of the Mayor and  Township Committee of the Township of Winslow to be held in the Mayor Dominic Maiese Municipal Complex, 125 S. Route 73, Braddock, New Jersey on March 10, 2026, commencing at 7:00 P.M., prevailing time, or at any time and place to which such meeting from time to time may be adjourned. All persons interested will be given an opportunity during said time to be heard concerning such Ordinance by order of the Mayor and Township Committee.
